Yes, they wear badges and drive black and white vehicles. But some Geek Squad agents seem to have taken the “agent” part of their title a little too literally.

Best Buy, the consumer electronics giant that owns the on-call computer repair service, recently admitted that four employees accepted money from the FBI after the agency received information from the agents about customers suspected of using child pornography. As a result, the Electronic Frontier Foundation in San Francisco is suing the Justice Department to reveal the extent of the FBI’s relationship with Best Buy.

The nonprofit foundation fears the FBI is recruiting Geek Squad operatives as undercover informants to spy on people through their devices — a violation, it argues, of the Fourth Amendment prohibition on illegal state search and seizure.

“When the government co-opts technicians who fix people, they are giving away unconstitutional research to private parties,” said Aaron Mackey, an attorney for the foundation.

The case raises important questions about protecting consumer privacy as concerns about government surveillance, particularly by third parties, mount. Edward Snowden, the National Security Agency’s contractor whistleblower, released documents showing that AT&T and Verizon gave the agency access to email and other data passing through their networks.

Reaching out to vendors who offer technology support offers the government a way to access information on hard drives or cloud servers without receiving a search warrant.

“Any decision to accept payment was very poor judgment and contrary to our training and policies,” Matt Furman, head of communications and public affairs, said in an email. “Three employees are no longer with the company and a fourth has been reprimanded and reassigned.”

According to Furman, employees acted independently when taking payments, and the money did not go to the company.

“Nearly 100 times a year, our Geek Squad repairers discover what appears to be child pornography on customers’ computers,” he said. “Our staff are not looking for this material; they accidentally find it while trying to confirm that we lost customer data recovery.”

Finding child pornography is one thing; Courts typically turn to law enforcement on such matters, said Scott Shackelford, an associate professor of business law and ethics who leads the cybersecurity program at Indiana University in Bloomington.

But when the FBI’s data-sniffing goes beyond illegal images, “it raises some serious questions about (the) FBI’s involvement with (Best Buy) employees,” Shackelford said.

A lot depends on what the Electronic Frontier Foundation is for. If the organization finds documents showing a close relationship between Best Buy and the FBI, it and other companies that provide tech support risk losing customer trust and confidence. Amazon and Best Buy, for example, have tried to extend technology services to homes and businesses.

“We’ll have to see what comes out of the foundation’s efforts,” said Darren Hayes, an assistant professor at Pace University’s Seidenberg School of Computing and Information Systems in New York. In polls by the Pew Research Center, 52 percent of respondents said they are “very concerned” or “somewhat concerned” about government surveillance of American data and communications. And 61 percent said they have little or no confidence that consumer data collected by retailers and other businesses will remain secure or private.

The relationship between Geek Squad agents and the FBI came to light after a federal grand jury indicted California doctor Mark Rettenmaier in 2014 for possession of child pornography.

Three years earlier, Rettenmaier took his computer to Best Buy’s Geek Squad counter for repairs. An employee discovered a pornographic image on the hard drive and notified the FBI. Based on this image, the FBI obtained a search warrant at Rettenmaier’s home, where court documents say agents found child pornography.

Best Buy requires anyone who turns in a computer for repair by its Geek Squad to sign a document certifying that the retailer will turn over any device containing child pornography to authorities. However, Geek Squad agents cannot specifically search for content; they may only act if they encounter it while performing the requested service.

“Our policies prohibit employees from doing anything other than what is necessary to resolve a customer’s problem,” Furman said.

According to emails in court documents, FBI agents maintained close ties with Geek Squad employees, even naming them “sources,” including the employee who found the images on Rettenmaier’s supervisor’s computer.

James Riddet, Rettenmaier’s attorney, questioned the validity of the warrant, arguing that the associate was searching for illegal material specifically on behalf of the FBI. Therefore, the court must suppress the evidence at Rettenmaier’s home because the arrest warrant was based on information on his hard drive that the government had illegally obtained.

“We still consider the search of informants to be illegal,” Riddet said in a short interview. “I think that’s something people should be aware of when they bring their gear to Best Buy.”

But a federal judge ruled against Rettenmaier, saying he consented to the search by signing the Best Buy document. (The judge eventually dismissed most of the evidence, but for a different reason: The images the employee found on his computer weren’t technically child pornography. The judge also adjourned the case a year later.)

“We are continuing to review the matter, so at this time there is no decision on how to proceed with the case,” Thom Mrozek, a spokesman for the US Attorney’s Office in Los Angeles, said in an email.

A person accused of possession of child pornography may not receive much public sympathy. But the case raises wider questions, experts said. Can third parties, motivated by money, search for other information on behalf of the government, asked Joshua Carlson, a Minneapolis attorney specializing in privacy and cybersecurity. What if other companies pay you to look for examples of copyright infringement or other intellectual property issues?

Geek Squad has been in legal trouble before. In 2013, Best Buy paid an undisclosed amount to settle a lawsuit filed by a college student who accused a Geek Squad agent of stealing nude photos from his computer and posting them online.
